Agreement to Arbitrate

You agree that any and all disputes, claims, or controversies arising out of or relating to this Arbitration Agreement or the relationship between you and Boxcar Mortgage, LLC dba Highland Mortgage or its parents, subsidiaries, or affiliates (collectively “Company”) — whether based in contract, tort, statute (including the Telephone Consumer Protection Act), fraud, or any other legal theory — shall be submitted to the American Arbitration Association (“AAA”) for confidential, final, and binding arbitration to be resolved by a single arbitrator.

You further agree that arbitration will take place on an individual basis. By entering this Arbitration Agreement, you and the Company agree to waive any right to a trial by jury and to participate in any class action.

Prohibition of Class Actions

You and Company agree that each may bring claims against the other only on an individual basis — not as a plaintiff or class member in any purported class or representative action. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief for that party's individual claim(s).

Arbitration Procedures

Arbitration shall be conducted in accordance with AAA Streamlined Rules for Arbitration and will comply with the AAA Consumer Minimum Standards. The AAA arbitrator has the exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of these terms.

Hearings will be conducted by teleconference or videoconference unless the arbitrator determines an in-person hearing is appropriate. Any in-person appearances will be held in your hometown. You must send a copy of the Demand for Arbitration via U.S. Mail to: Boxcar Mortgage LLC, 664 Seminole Ave NE, Suite #101, Atlanta, GA 30307.

Highland Mortgage Texting provides an easy way to receive alerts about promotional, mortgage, and payment information from almost any mobile device. Messaging frequency varies for each customer.

Will It Cost Anything?

Highland Mortgage will not charge you to send or receive text messages; however, message and data rates may apply depending on your wireless plan.

How to Stop Receiving Messages

To unsubscribe, text STOP to our short code, call 404-850-0959, or email support@highlandmtg.com. Highland Mortgage will honor your request within a reasonable time.

Command Terms

• STOP — Unsubscribe from all text messages.
• HELP — Receive help information and contact details.

By signing up for Highland Mortgage Texting and providing your phone number, you agree to this policy, our Privacy Policy, and our Terms of Use. You also agree that you are providing express written consent for Boxcar Mortgage, LLC dba Highland Mortgage, its affiliates and agents, and its service providers to contact you about your loan application, loan transaction, loan servicing, available rates, and other products by text message or phone call — including those made using an automatic telephone dialing system or an artificial or prerecorded voice — to the telephone number you have provided. This applies even if that number is on a Do Not Call Registry.

Message and data rates may apply. Consent to receive messages is not required as a condition of any purchase. By communicating with us by phone, you consent to calls being recorded and monitored.

The following operators are supported: Verizon Wireless, AT&T, Sprint, T-Mobile®, Boost, Virgin Mobile USA, Metro PCS, and U.S. Cellular. Carriers are not liable for delayed or undelivered messages.

Governing Law

The laws of the State of North Carolina, without regard to principles of conflict of laws, govern your use of Highland Mortgage Texting. Any action arising out of or relating to SMS Texting shall be filed only in the state or federal courts located in Mecklenburg County, North Carolina.
